The New York City based law firm of Rodriguez Law, P.C. today announced the formation of a new practice group, which will be known as the Wage and Hour Defense Practice Group, in response to the rapid growth of minimum wage, overtime, and tip lawsuits under the Fair Labor Standards Act, as well as investigations and audits by the United States and New York Departments of Labor.
The New York City based law firm of Rodriguez Law, P.C. today announced the formation of a new practice group, which will be known as the Wage and Hour Defense Practice Group which will defend every type of wage and hour claim, ranging from minimum wage issues, unpaid overtime, tip misappropriation, employee misclassification, off-the-clock work, and improper deductions from paychecks, among others, in federal and state courts, as well as audits and investigations before the U.S. and New York Department of Labor.
The number of class actions, collective actions, and DOL audits/investigations has soared due to plaintiff-friendly laws, mounting government enforcement efforts and the increasing amount of information available to employees. Virtually all aspects of employee compensation have become the target of collective and individual actions in both state and federal courts. Ongoing changes in federal regulations and expanding state regulations add to the compliance challenges facing employers.
“The establishment of a formal Wage and Hour Defense Practice Group follows on the heels of the successful launch of our Restaurant and Nightlife Practice Group just over 1 ½ years ago,” said Argilio Rodriguez, the firm’s Founder and Managing Attorney. “Defending wage and hour litigation in federal and state courts on behalf of our clients, many of which are restaurants, bars, and nightclubs, now accounts for over half of our litigation case load and continues to climb steadily with each passing year.”
In the span of just the last couple of years, Rodriguez Law has successfully handled numerous high-stakes, complex labor and employment matters in defense of our clients. As a result, Mr. Rodriguez has been named a Rising Star by Super Lawyers magazine in labor & employment defense litigation for both 2015 and 2016. Moreover, in March 2016 Mr. Rodriguez had the honor of serving as a panel speaker at a Continuing Legal Education Seminar hosted by the NYC Bar Association entitled Opening a Restaurant in New York City: Legal Issue Bootcamp regarding labor & employment issues affecting the restaurant industry.
